1. Parties
This agreement is made between the provider named in the legal notice of this website (“Provider”) and the person who requests the download with their invitation code (“Tester”).
2. Confidential information
This means all content of the closed alpha that is not public: the game in its test version including program files, game content, characters, texts, images, sounds, game rules, values and balancing, unpublished plans, access data, invitation codes and download links, as well as bugs and bug reports.
3. Obligations of the Tester
The Tester
- does not pass on the confidential information to third parties and does not make it publicly accessible; this also applies to screenshots, videos, streams, posts on social networks, forums and chat groups;
- does not pass on the download link, invitation code and game files and uses them only personally and only for testing;
- protects the files and access data appropriately against unauthorized access;
- does not try to take the game apart, or to read out or decrypt content, unless the law expressly permits it;
- deletes the test version at the Provider's request.
4. Exceptions
Information is not confidential if it is or becomes public without a breach by the Tester, if the Tester demonstrably already knew it lawfully or received it independently, or if a law or an authority requires its disclosure. The Provider may release individual content for publication in writing or in text form.
5. Feedback
The Tester may report bugs and suggestions for improvement. The Provider may use them freely and without compensation. For this the Tester grants a simple, unlimited right of use to their reports.
6. Alpha, no warranty
The test version is unfinished, may contain bugs and data loss, and is intended for testing only. There is no entitlement to a continuation of the tests, to access or to saved games. The Provider is liable without limitation in cases of intent and gross negligence and for injury to life, body and health; in cases of simple negligence only for the breach of essential contractual obligations and up to the amount of the typical, foreseeable damage. Further statutory liability remains unaffected.
7. Age
The Tester is at least 18 years old or has the consent of their legal guardians.
8. Data
As proof of consent the Provider stores the invitation code, the time, the version of this agreement and the IP address. Details are in the privacy policy.
9. Duration
The agreement applies from the time of consent for as long as the information is not public, but for at least two years after the end of the closed alpha. The Provider may block access at any time.
10. Final provisions
German law applies. If a provision is invalid, the others remain valid. Amendments require text form.
